If you're off of work, and you don't answer the phone when they call you, and they fire you, I'd get an attorney.

There are a lot of different scenarios that can come in to play when dealing with a company that feels the need to call employees on their off days. In your case, if they are calling on you and other employees for questions or emergencies, if they consistently get in touch with other employees and not you, then yes they will probably find a way to fire you for "dodging" their calls. I've worked around utilities where storms would create emergency call-ins, and the employees, unless out of state on vacation, had no reason to not expect a call for overtime when a storm or emergency came through. The ones that consistently "missed" the calls received lower raises and no promotions.

In many states, you can be fired for NO reason at all. How can your employer possibly KNOW you are home if you don't answer the phone? My employer doesn't even know my home number. I only use my cell. Even then, if I am not in the office, they have no way to know if the phone is with me.

If they aren't leaving messages, I'd say you were busy with something else when they called and since no one left a message, you thought it wasn't important. They don't have to know if you have caller ID or not, and if they ask tell them no.

If you are on call you might be in trouble otherwise say you screen your calls or you were in the basement or outside or something! i say that when work calls me!
