me and my boyfriend have been dating for a year i just turned 16 and he will be turning 17... can he be charged with stachatory rape????

Technically both of you could be charged with Statutory rape of the other. Not going to happen, unlikely any district attorney's office would file. Here is why. Since either of you are committing the crime, you would be advised not to testify for you would be admitting your commission of the same crime. Not going to happen. The fact is that at that age difference and at your ages, it is just not that big a deal. (Except with the moralist here who never got any when they were 16.) It will become a bit more problematic when you turn 17 and he wins the race to 18. Then it could be a misdemeanor, but really no one cares. Even if you got pregnant the most he would be charged with is a misdemeanor, which is up to 1 year in jail and that won't happen either. Minnesota has a better law, which says you have to be more than 36 months older than the person you are having sex with, an that person is a minor. So there 18 with 17 is not a crime.
Bottom line, be careful. Safe sex.

Judging by California's laws, it is only statutory rape if you and he are engaged in sexual activity. Since you are not less than 3 years younger than him, it should not be an issue. Unless you have a very conservative mother/father who knows that you are sexually active with this guy and presses charges.
Hope you know what you are getting into with older guys. Older guys expect a lot more than guys your own age. This coming from a seventeen year old who dated a nineteen year old when I was fifteen. God bless ya.

Be wise, practice abstinence. :D A relationship without sex is so much stronger because the connection is made not physically but emotionally and spiritually. I'm still virgin and will be till my wedding day. My future husband deserves it. It's a gift only given once.

It would be hard to believe that California would have a law like that regarding two consenting minors, but the state is so insane that it might.

Regardless, you still should not be having sex until marriage.

Questions like this have been asked on this board a lot, and there are a lot of conflicting replies, and I don't think most of the people here really know.

Statutaory rape refers to an adult having sex with a minor. In California an adult is 18, a minor under 18. You and your boyfriend are both minors. Dating is not necessarily considered to be sexual intercourse.

No, your boyfriend is a member of the same class that the law was passed to protect, thus, he cannot be prosecuted under that law.

no, i'm pretty sure statutory rape laws only apply if you're over 25. if you're 16-18, you can legally have sex with people as young as 12.

not sure though.

As for the question....

as long as your parents approve of you dating this guy (I didn't say sleeping with him) you and he are safe. But, if I were in your shoes, I'd stop having sex until you are more mature (and doesn't use wikipedia as a source) and don't have to worry about jail time for him or you for that matter.
