my 3 yr old son likes to pick them but it is my backyard

if they own the land and they grew them, they can pick them, and you should stop whining.

You should have some type of rental/lease agreement that was signed by you and the landlord. This should specify anything you cannot do or use. Most rentals of a house include the yard. This is not always true though. I rented a house and the rental agreement specified that I could not have a garden or plant any type of landscape. The property also included a garage which was not part of the rental agreement. It did not say the owner could use the yard though.

Depends what was in your rental agreement. Did you rent the property knowing that they have a vegetable garden? If not, and they just assumed they could use it, you may want to check out the Tenant Protection Act, or whatever it is called where you live. Call the local rental housing tribunal and ask for their advice. They will be able to instruct you on how to proceed.

no they have no right to use the back yard you are paying rent for the yard also.
