I'm unable to understand why you are giving so much stress on MOU? You work in a MNC & have learnt this term MOU; do you know its real importance even in other transactions other then matrimonial disputes? Firstly, as Buzzy (Binoe) & Pramod along with me have been telling you that this MOU has no legal value in matrimonial disputes & but you have kept on sing this MOU song in all your questions regarding your dispute. Secondly, what ever you agree or have understanding arrived in this so called MOU will be a piece of paper which the family court judge will not even look at, what ever you mention in the joint petition for divorce by mutual consent will only be looked into & each & every order concerning any issue will be made on the basis of that only. This includes your financial transactions agreed between both of you with regard to the permanent maintenance or Alimony or any other issue agreed , such as stridhan or custody of children as the case may be. Just keep this MOU in your file as any other official document you keep in your Company & be happy with it. In courts the judges see what is stated in the petition or application before him or her not your officially drafted MOU's. By the way don’t you have any legal consultant in your Company who has some knowledge of law with regard to MOU’s & matrimonial disputes? If you have, then check out with him that whatever I told you is correct or not.

A MOU had no bindings in the Legal Machinery of India when it comes to Family issues!!

You need to be applying for a Divorce ASAP!!

You could use the MOU when filing evidence or objections

You can include it but ask for a certified copy after filing it in the court. Make sure it is marked by consent when it is filed.

But what is included in the decree is what is finaly binding. It is better to include the payments made in the joint petition for mutual divorce.
