The straight answer to your first question is yes------I guess. I am sure this is not the answer you wanted, but the decision-making process the president uses in the execution of his office are covered under executive privilege. But, I don't think this is at all what happened.
The straight answer to your second question is yes, also. But, that' s a political question for Congress (specifically, the House of Representataives) to decide as to what is or is not an impeachable offense. I think it decidedly IS an impeachable offense to doctor the intelligence used to justify a war, then present the knowingly-doctored intell to Congress and the American people to get them to do what you want them to do. This is what I think happened.

I woulda thought it was an impeachable offense. kinda makes one wonder what's up with the Dems.

There are many impeachable offenses. We could start with warrantless wiretapping in violation of both FISA and the Fourth Amendment and go on from there, certainly including lying to America in order to start an unnecessary (and seemingly endless) war on a country that had not attacked us.
