I got into a car accident 2 days ago, a pretty bad one. I was in the car with my friend and we were waiting to turn into the Jack-in-the Box parking lot and this truck came to cross the street and slammed hard into the passenger door ( I was in the passenger seat.) He knocked us into oncoming traffic and we got hit head-on by another car. I was knocked unconcious when the truck hit us and my friend told me that we got hit the second time. Her car is totalled, as you can imagine. She wasn't hurt, but I have a fractured elbow, scratches from shattered glass, a decent size cut on the head, and I'm bruised all over from being knocked around the car.
Now, the only reason why I haven't called my lawyer ( who is my mom, ironically enough), is because this guy was old (60+). He shouldn't even been driving. And I half-*** believe him when he says he honestly didn't see me. And it isn't like I need the money...so what do you think I should do?

He offered it as is. Its probably an older automobile tht he offered for some hundred or some thousand. What do u anticipate? the sole way he could desire to sue you is that if he can teach tht u have been hidiing/no longer disclosing the certainty tht the automobile overheats. Tht would be impossible for him to teach. you would be fantastic. He won't take u to courtroom. in spite of if he does, he will lose. in line with threat call him returned and furnish a small factor of his money returned? If u do, make optimistic u get it in writing

see if he has vision problems and if he was wearing his glasses or not and if he is required on his license to wear them. i wasn't there so i cant really judge but maybe he did see you and maybe he didn't theres too many variables. i would council with your mom since shes a lawyer and see what she thinks is best but she may just want to sue him because your her kid and she wants to make him pay for hurting you. i guess just use your best judgment and do what you think is right. do you honestly believe that he didn't see you? regardless he caused you injuries and you are lucky that this didn't kill you and your friend. he is an elderly man so maybe he is telling the truth but if he is and he really didn't see you then he needs his license revoked so he can't hurt anyone else also he's lucky that he didn't kill you because he would be in a lot more trouble and he probably would have gone to jail. sorry for making this so long but this is the best answer i can do because i wasn't present at the accident.

1) You should talk to your mum about this.
2) No matter if he is young or old, if he is dangerous on the road, he should be stopped from driving. Sue him is a way to stop him.
3) It is his insurance paying for your medical bills and loss. If you had to take time off work or study, you should also be compensated for that.
4) If you dont need the money, you can donate it to others who does.
Do everybody a favor, remove dangerous drivers from behind the wheel.

while yes you probably feel sorry for the man, does that mean you have to suffer the trauma of a car accident and get injured just to avoid HIM suffering through a lawsuit?
you said it yourself: he shouldnt have been driving, maybe a lawsuit will be a wake up call for him and maybe the judge will prohibit him from drivning.
if you let it slide, he'll continue driving, puting other people at risk.
there are certain requirements for driving and while i feel sympathetic for the old man, VISION is a key requirement for being on the road.
in otherwords, sue him, for at least the medical expenses. or just talk to your mom, jeez...why WOULDNT u talk to her about this? u get in a serious car accident and you don't even tell your own mother??

"60+" is not old and the guy's age has nothing to do with anything.
Are you saying people over 60 should not be driving? How will your mother go to work when she is over 60? She'll need to work to pay for a spoiled brat like you.

sueing people is the whole reason f$%king insurance is so high but in you case thats a hard one to decide call some local lawyers and without giving your name out ask them what you should do

Talk to his insurance company, dont feel sorry for him ? last weekend a senior killed 6 people and Injured 17 that were walking on the road side.He says i never expected that many people on the road. This was in Abbotsford BC your mother may want to check t his out. I am a retired instructor. Apart of my job was taking seniors out for evaluations . some cried and didnt want to stop driving..By the way i am not not safe so turned in my licence 3 years ago.Thursday another senior jumped the curb and killed s 5 year old in front of his mother.

Talk to your lawyer (mom) . If you believe he has some kind of impairment (other than what you believe to be to old to drive) then he should not only pay for your pain and suffering, but he should be evaluated on his driving capabilities.
