In October, 2006, Bush signed into law the John Warner National Defense Authorization Act, which effectively overturns the Posse Comitatus Act of 1878. Theoretically, at least, Bush now doesn't even have to inform Congress if and when he declares martial law!
Under the new law, Bush can use the military in response to terrorist attacks, natural disasters or "other" condition[s] in which the President determines that domestic violence has occurred to the extent that state officials cannot maintain public order.
So, if the wealthy elitists, industrialists and power brokers who control the Bush White House decide that the GOP must remain in power, they will most likely stage another 'terrorist attack' on U.S. soil (this time in the Midwest, where emotions will run higher than they do when cities like New York or Washington are attacked). This will happen in the late summer or early fall of 2008, just prior to the elections. Bush will be ordered to declare martial law (which he now has the power to do), claiming that a change in administrations would not be in the best 'national interests' at this time.
The Republicans will remain in office without the worry of a pesky election.
One situation that might make the GOP decide differently: if the United States is hit with a severe economic depression (which is highly likely by late 2008), it would be in the Republicans best interests to take a moderate approach to the elections, letting the Democrats win. Since voters always blame the party in office, Democrats would then be lam blasted for the depression, and the Republicans could come back strong in 2012.
Either scenario depends on what the GOP believes is in its best interests just prior to the 2008 election. They will NOT risk losing to Democrats if they need to remain in Iraq and Iran for the sake of continued OIL and WAR PROFITEERING. They will rig the election in favor of the Democrats if it appears likely that the U.S. will suffer a disastrous economic catastrophe. Think I'm crazy? Why not print this out and put it away for safekeeping for a year and see how close I come to being right! -RKO- 09/01/07

Martial law is only used to quell domestic turmoil or to stop rioting. Another attack on America would not fit into that type of situation, just as the first attack on America did not produce a declaration of martial law.
