It depends on where you get it and why it's free.
If you download something with a valid license, or where it has been released by the author as freely distributable -- there are no penalties.
Paying for it (or not) is not the primary issue -- it's whether you have a valid license to download it or not.

If you mean FREE music there is no penalty. If you mean STOLEN music then it will depend upon how many songs you steal. It is much more than the cost of buying the music though.

none if it is free. If the music provider ingnored copyright laws and you weren't aware that you were illegally downloading song then the company is responsible. If you did know then I think it is just a fine.
