I have been a married homemaker for 23 years. I left my abusive husband in April 2007 and filed for child support for my 12 yr old daughter in May. I have no work force skills as a result of being a homemaker/stay at home mom for so long. My 29 yr old daughter bought a house in North Carolina and is willing to help me. San Diego, California is very expensive and I cannot afford housing or food on my own. He has not given me 1cent since I left. I have not filed for divorce and would like to move. Can someone tell me how to do it to avoid getting in trouble?

Move now and figure legal stuff later. the inter-state stuff is complicated, so time and distance is on your side. if he wants to, he can spend all the $$ and make all the motions. i did the same, deciding not to spend a penny on lawyers. meanwhile you'll be safe and beginning your new life. all possible. i'm a living testament to this! so what if it drags on for years; he's not helping you now so there's no reason to make it simple to wipe his hands of you.

Tread carefully. Every state is full of loopholes and hoops about moving away with a child. Some states can actually have the child removed from your care and sent back to the father. If he was abusive, go to your local family court and file a restraining order, and then file requests to move to the other state. A judge may allow such a move under these circumstances, especially if you have family to help you in the other state.

You better contact Legal Aid in your area. You should be able to move but I am no authority. If there has been nothing filed to prevent you moving and taking her you should be okay. I would certainly get a Legal opinion anyway. Most attorneys will answer a question like this on the phone.

You must seek legal counsel before you make a step like this. It could cause for huge complications if you do not have a divorce attorney to advise you. If you get sole custody of your daughter because of the abuse issue, moving wouldn't be a problem. But get it done legally before you take off.

move to south Carolina , then put a restraining order on him. this will protect you and since u r in a financial hard ship i dont think you could get into trouble , call the state police and ask them they should be able to tell you.

You can't if you have a child you have to get permission from the father before you move!
