You are not very clear on the circumstances. However, I will give it a shot. You apparently own land and your husband is building a house on the land. From your post, it seems that you want to sell the property but your husband doesn't want you to sell, nor does he want to sell his interest in the property. States differ in their laws. Some states consider real estate to be owned by both people who are married, regardless of who's name is on the deed. It may also depend on when the property was acquired. If it is in your name and was acquired prior to getting married, you could probably sell it, but your husband could have a lein on it if construction has begun on the house. Any buyer would likely want your husband to sign off his rights in the property. You need to talk to a lawyer who deals in real estate law. It sounds like you and your husband are getting a divorce?

First of all, whose name is on the deed? That person or person certainly has to sign any transfer. Secondly, if you live in a community property state (mostly in the west) both spouses (spice?) wll likely have an interest anyhow. Best to check with a knowledgable LOCAL real estate Attorney for your specific circumstances.

Nothing worse than having a deal ready to go and find out at the last minute that it can not close.

Is the land in your name or both your names? If it's solely in your name, you can sell whenever you want.
Are you in the process of a divorce or something? Cuz I'm not sure why you'd want to sell land that he's building something on.
Why not just sell it to him?

If you are in the USA and legally married, it takes both of you to sell.
