I have a serious situation here and I would ask for anybody's advice. I know someone that was driving along and they were with another person and that person was driving there car also. They were together but driving separate cars in one day. And one of the people got into a car accident, and before the police even arrived the other person that was with them got into the car that got into a car crash. The police will try to investigate I think. Will that person go to jail. What will happen now. Please help me this has not happened to me at all but a close family member of mine.

Both the driver and the pretend driver are committing serious offences of attempting to perverting the course of justice. Penalty for causing the crash - probably a fine - penalty for what is being done now - prison!!!!

I'm just a tad bit confused here. Are you saying that another person got behind the wheel and is saying they were driving? Or did they just get into the car as a passenger? If this is the case NO problem. They did not break any laws. But if they got into the car and are saying that they were the one driving they are lying and this being there is a reason for that. Did the other person have a license? But either way if they are lying yes that is illegal. They could be charged with making a false police report. In massachusetts this is a felony. They can also be charged with aiding and abetting. This is NOT to mention the problems that will arise from the insurance company. They may NOT want to pay as there are lies being told. UNLESS it is your car that is involved or your kid who is involved I'd keep my distance. Civil action can involve more than the auto. LIKE HOMES. But if this is a family member as you mentioned I'd most likely (if I were you) talk with him/her. Good luck either way.

This is Insurance Fraud and it is illegal. If they collect any money, it could be bad. And didn't the police notice an extra car around, anf the other car that crashed, did they see that person get into the other car?? Too easy to get busted on that kind of thing.

Dont underestimate the power of investigators, they know the right questions to ask and will eventually put the pieces together. Tell your loved one to fess up now or jail may be a possibility with a longer sentence for withholding evidence.

I don't think if it was just an accident anyone would go to jail, but are you telling us all the details? If someone was impaired, had a suspended license or an unregistered vehicle, etc., then there could be trouble.
