I was a victim of a internet scam, and the check cashing place where I cashed the check is now taking me to court to repay the money, I was accepted into the ARD program where I will not get a conviction just have to repay the money. I just started a new job and they finger printed me for my ID, and my arrest record came up, I start making payments on the 21st of september, and will be finished in January and the arrest record will be expunged I wanted to know if I could be fired, for this. On the application it ask have I ever been convicted of a crime.

Sounds like a good question for an attorney, but keep in mind that if your employment is in a "right to work" state, you can be fired for anything - or nothing - without being provided any reason or notice.
My recommendation is to be up front with your employer and tell them your specific situation. This will clear up any of the gray area and prevent them from making any assumptions.

Ultimately the Human Resource policies of your employer is makes that decision. If you are employes by a federal association (like a bank) or a government agency then you are probably out of a job. I would be up front with them about the situation and inform them immediately. don't let them just find out about it.

Your luck that your state has an ARD program. In California you would be convicted of Fraud.

As for being a victim... If someone told you that it feels good to jump off a building and that you can't get hurt are you going to cry 'victim' when you break every bone in your body? Hmmm...

I am a Bank V.P. and I see these internet scam situations all the time. From what you said it sounds like what you did constitutes fraud and simply saying "i didn't know" doesn't cut it. If I gave you a suitcase and paid you $10, 000 to deliver it to some shady guy and in route you were pulled over, the cop opened the case and found 10 kilos of cocaine would you be innocent becuase you 'didn't know'.

Don't take advantage of an opportunity just to make a quick buck. A good test would be this... if it is an easy quick buck it is probably illegal.

In many id not most states, you can be fired because they feel like it. Paying back the check cashing place is NOT an indication of doing anything wrong. You would have to d that if you cashed any check that was returned for any reason. If I were you, I would explain what happened. In this case, hiding what happened is more likely to get you in trouble than a conviction would be.

Absent an employment or union contract, you can be fired for any or no reason, as long as it's not race, religion, color...
