Each state has its own statute of limitations. In many states, the statute of limitations does not start to even run until the child turns 18. Accordingly, if there is a four year statute of limitations, the crime can be prosecuted up to four years after the victim turns 18 (or until he/she is 22). The best bet is to make an appointment with your local Assistant District Attorney (or State Attorney) or a lawyer in your area and ask.

In some states the statute of limitations STARTS when the victim turns 18. The actual statute varies by state. If in doubt, contact the DA and ask.

And yes you can prosecute as an adult in fact that is when it happens most of the time.
