her fathers house due to neglect and drugs. He and his wife tested possitive for meth and admitted to cooking it in the house with my daughter home!! His wife was 5mths pregnant at the time!!! I went to court and got new custody papers, the papers state that untill CPS gives me, (it specifically states my name) written notice her father may only have supervised visation. Well on October 11, 2005 CPS sent me a letter stating that due to their non-corroperation CPS was closing the case and that her father should not ever recieve unsupervised visitation. Last year he picked her up from school, (they have copies of all the paper work!!) the police went and got her. All summer long he has tried to go places where she was and take her. The police were called everytime and he was unsuccesful. Well yesterday he picked her up from school again, the police in his town have let him keep her this time because they say the CPS case is closed. I feel hopeless, what do I do? I can't pay for a lawyer

you need to go to court and file a protective order against him, take all the paper work you have from CPS and any other info like go to the police station and get a copy of his arrest records. They will then send a copy to the local police dept and you need to take a copy to school and everytime he violates this order call the police and file a report he will then be charged with violation of protective order and could face jail time. Get your custody papers together and take them to the police in your town. I am assuming that your daughter was taken from your town. Which makes your police involved. This is probably your best chance for this long weekend to get her back home.
Tell the police that you want to press charges.

Your next step is legal aid.

Check your local telephone book for legal aid. they can find you a lawyer for little or no cost to you, or check out http://www.lawhelp.org Your child shouldn't be subjected to such an unhealthy environment and clearly the police are not doing their job. Legal Aid can help steer you in the right direction to get your daughter back.

quite i don't locate weed a substantial difficulty as long as he's remote from the infant and is in charge parent. i don't see how they could immediately assume he's a ineffective beat dad. yet to respond to your question it may be counted on the area on your case they could probable prefer your babys dad to flow to drug counseling first. Cps continually supply you a huge gamble to get well your self beforehand they do any drastic differences

It would help if your custody order stated per se that you have legal and physical custody, and dad's visitation is only to be supervised and only on such and such dates. If you can't afford a lawyer, try using a paralegal typing service. They will know what forms to use and can prepare your papers based on what you tell them.

Can't, or won't pay for a lawyer? This is your child's safety here, whats more important than that?
Go see a attorney, tell him/her whats going on. Most likely they will work out a payment plan, or better yet, make the dad pay your legal fees.
Or do the research yourself and file the Motions in court yourself.
Instead of being here on Q&A feeling "helpless", get off your backside and go fight for your child!
