I've been here 12 years and have always been a decent tenant. I went to do the annual paperwork regarding my rental assistance and was told this by the property manager when I was expecting to sign a new lease. (She's unhappy with me because I've complained about some things.) So, I assume that they are not going to renew my lease. It's been a week and a half and nobody will tell me anything. My current lease is up in two months. If I leave sometime this month will they say I'm breaking my current lease? What are my rights here? I live in Indiana.

I goofed. I meant to say that she said my FILE was under evaluation not my lease. Sorry.

You cannot leave while your lease is in effect without written permission, or you will be liable for the remaining rent (unless the conditions in the apartment are considered unfit for human habitation, i.e. no working heat or plumbing, etc). It may not seem fair that your landlord wants to get rid of you, but keep in mind that the lease is binding on him too and it's not like he can just throw you out whenever he wants like landlords could in the bad old days. Even if he doesn't tell you his decision until the lease expires, you will legally have at least 30 days notice to leave and that should be perfectly adequate time to look for a new place. Ultimately, if a landlord doesn't want you around for whatever reason, nobody should be able to force him to renew the lease to allow you to stay there. You are living on his property, after all. But if he's angry at you because you complained about any health code violations, building code violations, or any other kind of housing law violations, feel free to call your local housing authorities and report him.

Start looking for a new place NOW and be ready to move at the end of your lease. And, if you have been complaining, maybe you should be happy you have a chance to find a new place. They need to tell you though.

Even if they don't renew or you are "evicted" they have to give you time to look for a place. If they don't renew, they may charge you market rent while you stay past the end of the lease.

I think that it is best to look for a new flat right now. This is a sign of poor management. It is vindictive. It sounds like they can not find anything to evict you on so this is how they will deal with you. Staying there even if they offer you a lease would not be pleasant. I would think that since they made the first move you would be well within your rights to leave when you are ready but I am no attorney. Best of luck.

I would suggest you look for a new place and plan on moving in two months. While I cannot guarentee that they will not renew your lease, that would be my guess.

You've been there 12 years and this how they do you?! I would think your many years there would count for something. Guess not. Well, I wouldn't want to stay someplace where they did me like that. I'd find someplace else and tell them to kiss my grits!
