The laws in Canada and the US etc are different. Annulment in Canada is very rare. There are various web sites you can visit for more info. A divorce in Canada requires you to be separated for one year. Since there is a child involved you will have to have child support in place before the divorce. The best advise is to see a lawyer. Although there is a cost involved speak to the lawyer to arrange payments. You ex cannot contest the divorce if you were married in Canada. You should be able to get sole custody since he has not been in the picture. I do not know the rules for the US or other countries. At any rate you need to talk to a lawyer.

You can't get an annulment, you must file for divorce.
An annulment is only allowed if one party blatently lied either on the marriage certificate or to their partner, ie still married to someone else, short time to live, convicted molester, etc.
My annulment was that her divorce decree said neither shall remarry except to each other for a period of 1 yr after divorce final...she married me 2 mths after final.

You can't get an annulment. You consumated your marriage. You're going to have to talk with a lawyer and find out what it is you have to do to get a divorce, even though you say you can't find him.

You're not in annulment territory--this requires a divorce. Get a lawyer, there's a way to get it done.
