i was in a car accident i have a 2003 Buick century and my air bags did not pop...do you think i should file a lawsuit agiants GM or Buick...im not even finished paying the car im okay but did go to the er...what shoul i do???? can someone help???

Airbags don't automatically "pop" for every accident. They're computer controlled to deploy under very specific circumstances. You many need to do some research before you start suing. What did your insurance company do or say? They are the ones you should be talking to.

You are stuck between a rock and a hard place. General Motor's Dealerships are the most qualified to diagnose whether the air bag sensors have malfunctioned. It will be a risk to consult an independent shop for their opinion because they are not specialists in just GM vehicles. The answer you will probably get from a GM mechanic is that the impact was not severe enough to deploy the Air bag. Air bags are not designed to deploy every time a vehicle has a collision. I sense that because you did take the time to ask this question that you are not the dishonest type out to make a quick buck like some injury attorneys would. To get the best settlement you have to miss work and visit the doctor frequently. I tell you this because I was really injured in a car crash. I was stopped at a stop light and was rear ended by a gentleman smoking marijuana. I almost got high just smelling the marijuana coming off his clothes. 20 years later I still have a stiff neck as a result of that injury. I can't turn my head enough to see the blind spot on each side. Thank goodness for those blind spot mirrors. Good luck whatever you decide to do.

There's a hundred reasons it might not of gone off. If it wasn't hit the right way or if you weren't going fast enough. The fact that you went to the ER doesn't really say much because the fact your thinking about sueing GM tells us your a complainer and would probably go to the ER if you fell and scraped your knee The odds are it would be a wast of your time and money and you'd get nothing. I was in a motorcycle accident I fractured one of my arms and got some good road burn I jumped up grabbed some duct tape and a paper towel made a bandage and got lunch grow up it's not the end of the world their's a reason most people have insurance.

Did you buy th car new ? or was it used? were the Imoact sensors in the front of the car operational . these are questions that are going to be asked if you try and sue you need to make sure that there was not any human error involved that caused the Bags not to deploy . In order to win you are going to have to prove that the Srs System was at fault for the nonDeployment and not a sensor left unplugged or a disconnected Air bag .
Get a good lawyer if you go this route.

Marg,How fast were ya goin'? and where were ya "hit"? Who did ya buy the car off of/ Did ya get a "steal of a Deal"? on a used one?Did ya check Car Fax to see if it had been in an accident before?Or did ya have someone look at it to see if the paint and sheetmetal all lined up( cause all accidents aren't reported to Carfax). They are only suppose to go off after a certain type impact AT A CERTAIN SPEED!!!!You are OK? So, what's the beef?The car kept you from being seriously injured(Buick is #1 in quality and Safety) Who's fault is it? yours or their's? Maybe, you should look at who's fault it is and just thank GOD you are OK!!!!That is why we pay such high prices for an aspirin($8) at the hospital. GM,Ford,Chrysler, and the rest of the car Co.s charge an extra $5,000-$14,000 for vehicles cause everone is "sue happy"!!!Insurance Co.s also charge an extra $1200 a yr for insurance cause people want something for nothin'! Doctors' charge $50,000 to deliver a baby. Why don't ya sue the Oil Co's for selling gasoline to this idiot and the State for giving who ever was at fault a license for the accident(obviously they could not drive cause they caused a wreck from neglect)

Airbags are supposed to go off in severe accidents, where you would otherwise be slamming into the windshield or getting bad whiplash. If anything bad like that happened to you, then you have a case. Otherwise, a low speed fender bender is not supposed to set off the airbag. This is because, as someone else said with a family story, airbags open up with an explosion, which can cause injuries. So ideally they only open in accidents where you are actually in danger.

For more information, get a lawyer that specializes in personal injury suits.

You can ask them to check the air bags but air bags are made to go off depending on how you where hit, where on the car you where hit and how fast.

Your alive and sometimes the air bags kill...Count your blessings and if it really bothers you...don't buy a buick again.

It depends on speed, impact area,seat belts on and even the weight of the occupants,to say the air bags should go off for any accident is not correct.The air bags can injury you more than an accident if they deploy when they shouldn't.

Were you hit in the front or in the side? If hit in the side the airbags are designed not to go off. If hit in front they are. If in back you should have your head rest all the way up to prevent whip lash and the airbag should probably go off.

Also, shoulder harnesses will not lock if hit on the side of the car. Basically I am telling you to drive defensively and be careful out there.

first thing you need to have done is have the car inspected,and have them find out the fault of why they didn't deploy,there may be a good reason for this,but in any accident severe they should have deployed,you cant sue without having proof,you need a thorough inspection of the car to determine why they didn't,then talk to a lawyer,there are certain steps you take in everything,get proof,and get a reason for them not deploying,remember you going to be fighting with gm,not a small company,good luck with it,
