Consensual sex, yes. In a public bathroom, NO. What if children are present? If they are that horny and meet in a restroom, they can be mature about it and get a motel room!

Consensual sex between adults is fine but not in a public place, especially a bathroom, that's just nasty sick.

It should, but it probably won't.

The govt is allowed to regulate public conduct that might might other people feel embarrassed or uncomfortable -- even if everyone who is actually involved is fully consenting.

So, this is another example of conduct that is banned in public, based on the fact that people are consider too incapable of managing their own emotional reactions -- and thus the govt must step in to protect them from having to see or hear anything they might find offensive.
