This makes sense to you? If the fetus is a person, ANYONE killing it is a murderer. If the fetus is NOT a person, then anyone killing it can't be charged with murder.
You state that if a mother kills it, then it is NOT murder. But if someone else does. It IS murder????

coragryph (below) Death is exempt from legal consent. Other than the Death penalty. One cannot consent to being assasinated even if they want to die. The killer will be tried for murder if caught. Even if the killer has a signed and notorized consent form from the victim.

Because it's the person who is carrying the childs choice. Jessie Davis was going to have that child to her it was a baby. She was days away from having that child. She even had chloe picked out as a name. IF MR. Cutts didn't interfer in the process that baby would be alive today.
By the way Bush did away with late term abortion before Jessie was killed.

It appears as though Ohio has a fetal homicide law. While I do not know exactly what the Ohio law states..most say something about the fetus being "viable". Wasn't she 8 months pregnant? If that's the case then the fetus(baby) would definitely be considered "viable". Had she only been two months pregnant, they probably couldn't have charged him with the additional homicide.
Regardless of your views regarding this situation, abortion is legal...murder is NOT.

I'm always amazed when I hear feminists cry, "George Bush is the biggest threat to abortion rights in years!" I completely disagree. Scott Peterson - and now Bobby Cutts - are the biggest threats to abortion rights in years.
We can't have it both ways - it's either a baby or it's not.
Hey, Googie - I'm pro-choice. But I also think abortion is way out of control in this country. Do you honestly believe that more than 43,000,000 babies since Roe v. Wade are the products of rape or incest? And what about the rights of the father? If the mother can decide to abort the baby - or fetus, if you prefer - without his consent, is it fair to expect him to pay for a baby that is born without his consent?
Cora - you bring up a very good point. But what about women like the one who shot herself in the stomach at full-term? Should she have been charged with anything? And what? (As I recall, she wasn't - but it certainly raises some questions.) Not trying to be difficult, but I know you like to debate, so I just had to play devil's advocate.

Did you read the article you cited? The mother was due in early July. She was killed in mid-June. That means the baby could have survived on its own, and that means the baby was far more than just a "fetus." There's a HUGE difference between first trimester and third trimester. I'm pretty sure that killing a pregnant woman in her first trimester cannot earn someone a murder charge.

There are many things that are legal if you have a person's consent and illegal otherwise.
For example, sex with consent is generally legal. Sex without consent is rape. Huge legal difference.
For the same reason, there is a huge legal difference between a woman choosing to have an abortion and consenting to the medical procedure -- versus someone attacker her and causing her to terminate the pregnancy without her consent.

Because Jessie Davis was due any day at the time of her murder and intended to have the child. It was a viable fetus.
You people are never going to overturn Roe v. Wade, so just accept that it is a woman's personal decision whether or not to incubate a fetus for nine months, and get over it.
Wedge issues don't impress me, or anyone.

You would understand if you have ever tried to have a child or if you had ever had a child. An unborn fetus is a future child. That could've been someone's most precious part of their life. Think of all the people who would be upset if you would've died at birth.

1st answer is that the police can charge him with an additional count of murder to make sure he never gets out, it is quite a good ammendment to abortion laws to make sure they murderers get charged with a secondcount of murder , 2nd the baby was about to be born which would make an abortion illegal because of the partial birth abortion/late term abortion ban

I know what you're getting at, and I still believe abortion should be legal. I do NOT believe in abortion, but I believe it is a person's right to choose. If they decide to do it, then they have to deal with God on that, not me...
