Is it a first amendment violation for a public high school to rent out it's auditorium to be used as a church on Sundays?

Nope. It may violate a town or school board policy, but not the 1st Amendment. My local HS rents the cafeteria out to a local church for Kids Bible Study classes on Sunday. They can rent it out to the KKK if they want to.

Not necessarily -- if the hall can be rented by any organization, or by any non-profit organization, on a first-come first-served basis -- that's not a 1st Amendment violation because no special treatment is being shown to one particular religion.

However, if the offer is only to one particular church or religion, and not open to anyone else -- that is a violation.

If it refuses to rent it out on the same terms to other religions or refuses to allow a group of peaceful athiests to rent the auditorium then I suspect it would violate The Constitution.

I wouldn't think so if all the school is doing is renting out the facilities. Ultimately it doesn't cost the tax payers anything.

not if they rent it out to Pagans on other days......... but if they ONLY allow christians to use it, then it is a violation of separation of church and state -- it is only a 1st amendment if they limit freedom of speech.
