Can anyone give me some good advice to take with me into court over this.

My Ex who owes my children (ages 10 and 6) approximately $20,000 ($10,600.00 for year 2006 and approximately $10,000.00 for 2007) has hired not an attorney but a psychologist!!! A psychologist can not practice law ... can they?

This guy seems like a real crook (the psychologist) - even has a web site. www.chicagodivorce.com

If you investigate this Richard Delorto guy he has been in trouble with the State of Illinois for fraud, arrested for tresspassing, etc.

What are the penalties for practicing law without having the education and license to? What can happen to my Ex since he has hired this guy to represent him in court? What can I do to better prepare myself and my lawyer before we go to court in a few weeks?

I really need some thorough and sound advice to be able to defend my kids' rights in the best possible manner I can.

Just to add a little more detail - This is the 6th time my Ex has been held in contempt in the last 5 years no less. My lawyer has researched this guy and no where is there a Richard Delorto anywhere that is licensed to practice law. My Ex makes a 6 figure salary and he has even told the judge that he has hired an attorney. We have already post-poned this case 3 times. 1. to give my Ex time to get an attorney; 2. an emergency with the judge occured and 3. two weddings occured before our case which put it behind time wise. The judge even said to my Ex that with or without a lawyer we are proceeding the next time and it will not be post-poned again unless there are circumstances beyond control.

I don't think the judge is going to like it when he finds out this guys a psychologist and NOT an attorney.

Isn't it like practicing medicine without being a doctor?

I just want to be as prepared as I possibly can be...

LMFAO!!! are you freaking serious??? omg!! if he does not have a state bar number to practice law...he is not allowed to practice law. what freaking Law & Order show is your ex watching? the judge will have the nutball removed (which one i'm not really sure, maybe both of them). let your attorney handle it. he'll need a good laugh.

The court system is about how well the lawyers play the game. It is not a forum for psychologists....they deal with mental and emotional issues...they are not experts in the court system. There is not a lot of fairness or psychology in the court system....so having a psychologist on his side will not make a scrap of difference.....its his lawyer who knows the tricks, not the psychologist. Judges arent stupid either and I dont think they would appreciate trying to be hoodwinked by a lowly psychologist.....Judges see themselves as very important...so any mind games his psychologist tries to play with the judge, will probably go against him. Just hire a good lawyer.....they are the ones who knows the judicial system best.

Sorry, but without knowing all the details of your case and the laws in your state, noone can really give you any legal advice that is accurate. You really should ask your lawyer these Q's. Good luck! Doesn't seem like your ex has a leg to stand on, so I wouldn't worry too much. Again, best wishes.

Your lawyer should already be planning and preparing a good case for you. You shouldn't need yahoos doing the planning or giving you advice. If there's back child support, your attorney will present this in court. It shouldn't matter what kind of yahoo attorney your husband has. You should be concentrating on your attorney, not his.

So....let me get this straight......he is going to court with someone that will say he is nuts so he cannot pay support...Huh.
Well that is a new one. Tell your attorney to make him get an independant evaluation, someone not on your hubby's payroll....the judge can delay his ruling until he gets the report. It is possible that this Delorto could have a dual degree, his Jurist Doctorate and his MD. Either way, if he,(the Ex), has a steady job, he is liable for support and arrears. Its all smoke and mirrors. Don't worry.

He can represent himself may people do..and if they are savy enough, they might win...SO I would be more concerned about whether my paperwork was in order and if MY lawyer was following my instructions rather than trying to point fingers at my ex.
If he has been in contempt 5 times than I want to make sure it is mentioned the current order. I'd be logging onto my states superior court or running down to talk to the clerk to see what additional paperwork needs to be files. I would not be leaving it all to my lawyer. You need to tell him/her what you want to see happen and provide him with all the evidence you have.

I'm fairly certain anyone can represent you in court - but the judge normally doesn't like it very much. It's almost like getting a mechanic to fix your computer instead of your car.

Don't let it get under your skin and I'm sure your lawyer will do his job and cream your husband.

i say dont sweat it,let your lawyer handle matters.If your ex makes 6 figure salary,then he will probably be held in contempt.I mean,what kind of excuse can a psychologist give that would excuse non payment of child support.

Just make sure your lawyer is aware of Mr Delorto's background. He will know the best things to do and say.
