I paid an initial fee of $750 June 29. As of, August 31 my husband has not been served, she will not return my calls, etc.

I sent a letter to release her and recover some of my money. She finally called before she recieved the letter. She said she had been in court.

I finally talked to her this week and she said she would have to check with her assistant.

I do not know what my next step should be.

I would just tell her that I would like a refund of my Initial payment because she really hasn't done anything to help you on your case! If she has been in court that much you might could also tell her that it doesn't seen that she has enough time to handle you case properly!! She will probably understand. I would also search around for new counsel that can get you husband served!

I would take her to court to recover some of the cost. You can do it yourself. Demand that she show how much she has charged you, prove it and give you money back. The key is that there needs to be proof. Go to the court house and check your file and see what has been done so far. She is a poor lawyer for not getting back with you and for telling you that she has been to court without telling you. Good luck.

Get in touch with your State's Bar Association. They can tell you if there has been any complaints against her. They can also tell you how to file a complaint . In the future always check the Bar for a lawyer's record before hiring him or her.

the fact that your husband hasn't been served isn't necessarily the fault of your attorney. ask your attorney why he has not been served yet ? it might be the fault of the process server (hired by the attorney) to deliver the legal forms to your x . you might need to give more information about where / when to find your x so that they can be served the forms.

Call your attorney's office and make an appointment to meet with her in person. If they won't give you an appointment, cold call them. Your more likely to get answers to your questions sitting down face to face with your attorney.

call the american bar association and ask if you have cause to report her.
