can she press charges for anything? what can she do??? shes having trouble with her dad. hes verry controlling and wont let her do squat...can she press charges for harrasment?

Ohhh that's just ugly. I wouldn't call it harrassment, but maybe assault or kidnapping. If she really wants to file charges, call the police and complain.

It's kidnapping. Is she still under restraint? That is, are you in communication with her? Is she free?

If you cannot communicate with her and you believe she is held against her will, tell the police. If they blow you off, go find a lawyer with time on his hands. Check out the courthouse for guys dressed like lawyers who seem to have nothing to do but hang out. Believe me, every urban county has marginally-employed lawyers who might take the case for the publicity and creds.

The lawsuit is for habeas corpus. You sue as "next friend" and if your lawyer wants to get creative, you also sue as the proprietor of consortium to your fiancee. That means that as you are betrothed, you and she share a loving, intimate relationship that the court should recognize as giving you the right to maintain the suit. Habeas corpus is a lawsuit that can be brought whenever it is claimed that a human being is unlawfully restrained from movement.

If she's not under restraint, then move her out of the home and use whatever means are needed to defend your home against an invader who would assault your betrothed. I'm deadly serious, the law gives you certain rights in defending your home against felonious invasion, and you could put an end to this mess quite convincingly. Please don't kill him, you fiancee would be majorly jacked-up were you to do so, and the legal bills to defend the manslaughter case could bankrupt a small nation. Try not to hurt him, laying hands as gently as you can, but firmly to resist the invasion. This will not be a time for gratuitous violence or great nastiness: it's nasty enough already.

If you can't give her a home, then get over it until you have grown up enough to defend what's yours.

This is defiantly abuse. Your fiance needs to get away from him NOW. She can either go to the local shelter for abused women, or go into hiding with a friend. She also needs to take out a "protective order" against her Dad. These are court orders that protect the abused party. They are not a joke. In Texas you can go to Prison for violating one. Are you active in a Church? If you are , and the put their actions where their beliefs are, they will help you also. Oh yes, you take out a protective order yourself. This will give you and your family protection. Also, it is a bit late for this but what are your State's laws on Concealed Carry of a firearm? You need one and your fiance does too. If her Father is abusive than he is probably abusing other members of his family also. If your fiance means anything to you fall over backwards to help her. Try to get your family involved. This guy is just a low grade bully. You can fix his @$$ good, if you work the system.

It is, in fact, kidnapping, and as her fiance, you have a legal stake in what happens. You have the right to call police and have an investigation begun. You might even be able to press charges over and above what the D.A. might want to pursue. Get the cops involved immediately! that girl's father needs to be arrested. He is definitely committing a felony. Kidnapping, forced abduction, unlawful restraint, false imprisonment, harassment. Those are some of the crimes he's committed against her, and by extension, you.

Check your yellow pages for family services, and you could file a complaint seeing the assault happening. Why don't you.

She is using real id, not fake id around you? Do you really know this person that well?

I personally think kidnapping and abusing your child is more "sick."

She's an adult and he kidnapped her and forced her to go against her will. He can NOT do that. He can kick her out of his house, but he certainly can't keep her from leaving. What's that? False imprisonment?

Taking any adult against their will is kidnapping. It may depend on the circumstances - is she better off with him or without him?

Unless he has court order that gives him custody of her as an adult, it's felony kidnapping.

Her father may not behave in the best of ways, ok, but pressing charges on your father is just sick and a sign of a sick society. Now give me the thumbs down.
