In Florida- can a lawyer not file a mortage as part of the agreement when hired- for non-payment of his fees. He wouldn't return my calls to find out why he didn't file my mortgage so I stopped paying him. He called me for the money. I had to start paying him again but it took him 18 months to file the mortgage after it was signed. What rules of ethics has he violated??

Ease up on the lawyer bashing. I know that 99% of the lawyers out there make the rest of us look bad.

All states have a code of ethics that lawyers must uphold. One of those rules is diligence. If your attorney took 18 months to file a mortgage, what was he doing? An attorney has the duty to keep his client informed of the status of your case. If he never returned a phone call, that could be a violation as well.

It is not the bar association you want but the state attorney diciplinary commision. The bar association is like a union for lawyers. Some states have the bar association run their ethics commission so it may vary depending on where you live.

If you think your lawyer or any lawyer has violated the code of professional conduct, you should file a written complaint with the appropriate state body.

Try calling the Florida State Bar Association, and file a complaint.

I don't know, but I do know that when a lawyer takes the bar he has six sections he has to pass. One of them is Ethics. So, what has always bugged me is why is it that they need Ethics to become a lawyer and one of the first things they do afterwards is violate any Ethics they were supposed to protect.

If you don't pay the agreed upon fee, I don't think he has to do what you hired him for. However, if he stuck you with unfair charges, contact the State Law Board.
