If the judgment creditor has the debtors drivers license # info what is the fastest course of action against the debtor to get my money?he don't have job.....but i think he have section 8,or warfare. Is there a way to Garnish his govement check?how ?

In order to collect on a judgment, you must proceed against a debtor's assets. If the debtor has no assets, you will not be able to collect. Also, in the instance of a person who has all of his assets in joint ownership with a spouse, you will not be able to levy against the joint assets unless the both spouses were liable for the debt.

If the debtor owns any kind of property, real estate, antiques, firearms, automobiles, etc., you will be able to levy against the interest the debtor has in those assets. You can secure a writ of execution against them.

You can get a writ of execution against a bank account account owned by a debtor, but the levy may not be against a joint account where one of the owners is not a debtor.

You may not levy against an account that has Social Security deposited to it.

If the debtor files for bankruptcy, either under Section 13 (wage-earner plan) or Section 7 (for discharge of the debt), you may end up receiving nothing.

For best results, hire an attorney to advise you. Many attorneys specialize in collecting debts. In general, they will be more successful in finding and executing on the debtor's assets.
