If someone fell for one of those email cash this money order thingy scams and cashed the money orders, will they get into trouble with the law? What if the check casher called in the money order and verified it was genuine?

I'm not sure if this is what you're talking about, but an attorney in NY fell for one of those Nigerian scams and spent 5 years in prison (I read about it in the ABA Journal). However, I think you've posed a different question. If you fell for a scam and the money order was verified, the legal problem is now transfered to the bank. They are professionals (legally if not factually) and you have a right to rely on their duty to verify the money order. In your fact pattern, you have no liability. You transfered it to the bank when they checked on the money order.

The question you stated, had nothing illegal in it. The problem comes when it is a check that is deposited and the sender is sent back cash (by money order) and then the check bounces. The account holder where the check was deposited is out all the money from the check and cash received to buy the money order.

Not legal trouble. But the person who presented the Money Order will be responisible for the WHOLE amount withdrawn, not just their "Commission"....
And yes, the Bank will come after them, and has done so with many before.

You still owe the money you cash out of the fake money order. Hope you didnt spend it or send it.
