IF your Mom had a court order that dates back; then yes, she can sue him for back child support. The courts will enforce a previous order even after you're 18, but will not create a new order if one didn't exist before you turned 18.

First Off Your Mother would have to be the one who should have done it 18 years ago! If he was never ordered to pay any child support then he doesn't owe anything. She cant go back and change the past but he could be ordered to pay until you are 19 which is the age of majority in most states. But other than that there is nothing that can be done.

The child cannot sue the parent for the back child support.
If your mother was not paid the child support that your father was supposed to pay her to contribute to your upbringing; she can bring a lawsuit against him.
This does depend on the general Federal laws regarding child support and does depend on the state laws where the marriage and divorce took place, as well as the support orders that were issued at the time of the divorce.

Were there legal papers requiring child support payments? If so, she can still file to get the back support. If she is deceased, you can file as part of her estate. When in Florida, the State filed charges because my wifes children had not received payments due to not knowing where the Father was. He is still paying even though the kids are 23 and 22.

I know for a fact that you can, as long as you are over the age of 18 you can sew him for back child support, but you only have a certain amount of time after turning 18 to do it. I think it's until you are 19. Get a lawyer and do it while you have the chance. Since your mom did not take him to court while you were underage the money goes to you now if you sew him, but it would be the right thing to do to share that money with your mother who has supported you over the years.

Child Support Judgements take effect the month following the service of the summons and complaints. Being that you are an adult now, they cant serve him to pay future child support, so no, you cant, nor can your mother.
Let me clarify... if there's not already a judgement filed, then no you cant try to file a new claim. If there is a judgement he will owe it until the day he dies or he pays it, whichever comes 1st

Yes. People sue for child support in arrears and they win. Collecting on the judgement is a totally different issue though/

your mom would have to do it, and if she didn't already have a court order in place I believe she can only go back two years.. at least that what my state agency told me when I filed for my son- not sure about your state though... if she did have a court order in place than she can go for as far back as the court order was in place
