of a lease I have with an apt. complex. Basically, I have had alot of trouble out of the complex. I live on the 2nd (top) story. My stairway coming to my apt. has gaping wholes in it, where there should be small boards, so children/pets won't fall thru. Also, my balcony is in really bad shape. When you go out on it, it shakes really bad, as if it's going to fall. The pools haven't been open all summer. Just alot of problems. Is there anyway, legally to get out of my lease? Thanks in advance :)

I bet if you claim that the luxuries AND necessities they advertised aren't available, then you may be able to get out of it. Assuming it's a binding contract for a set amount of months - you'll probably need a legal representative on hand when you go over this with your leaser.

Depending on the type of lease/tenancy agreement you have determines the notice period you can give. Normally they are a 6 month or 12 month term. If you have a tenancy that is renewed every 6 months, the notice period is 2 months after 4 months for the tenant or the landlord. If you are are on a periodic tenancy (rolling) it is 2 months notice either way.

You should check your tenancy agreement, the Landlord should be responsible for repairs to the apartment and the balcony as this is his property,and it should be safe to live in. With regard to the stairway this may not be covered by the landlord but someone somewhere is responsible find out who. If the property is managed by a Letting Agent speak to them they will have to look into 1: Your complaints about the apartment (i.e) any repairs that are needed because the property is unsafe in anyway, put this in writing, it has to be recorded and kept on record. 2: Ask them who is responsible for the upkeep of the stairway leading to the apartment, put this in writing as well.

How long has it been like this? Most leases are one year so I am assuming that for whatever reason, you moved in with those conditions. Unless there are actual safety hazards, you will not likely get out of the lease.

Document everything wrong with the apartment and the stairs. Get pictures and video. Take it to a lawyer.
