It would fall under the tort of invasion of privacy, and it is a very techincal law suit. Even I would have to research this before I could give you specifics. However, if they intentionally used your likeness without permission for commercial purposes, you will very likely get at least 1,000 dollars. The reason I say 1,000 is because that is the amount the Law Student that sued PMBR got out of them in settlement. PMBR without the student's permission used his name and a letter he wrote praising their bar reveiw course in an advertisement.

It would really depend on the specific facts of the case though.
