I want to know the specifics with regard to law in the State of California on this subject. Who makes the illegal action in the downloading of a song. Is the person who downloads the song guilty and under threat of facing a civil action, or is the person who allows the uploading of a song already in their possession. are they both at risk of a civil action. by what means do authorities find out when a song as been downloaded or uploaded?

both parties are in voilation of the law, however it is easier to find the download addresses as there are more of them in the log files from the server. All server transactions write to a log file, which any fair hacker can open. The gov has some better then fair computer people. Also line traces can be done (with a court order) during the transaction from the host server. The size of the log file determines when it will be overwritten, the smaller the size the sooner it over writes.

Unless your a head of a illegal and pirating music organization, it's likely they'll never find you, Use Kazaa and Limewire its filesharing, not illegal =]. And by the way, both parties will be held responsible.

Not sure in your case, but here in the UK a young man was fined some £5,000.00 ($10,000) for illegal downloads from music sites. His parents were not happy, believe me!
