By definition, justice should always be fair. However, the application of justice as exercised by criminal and civil "justice" systems is often not fair. The very rich can afford the best legal minds while the very poor get a public defender without a huge budget. That's just the reality of life in any system, no system is perfect.
In the US, considering ever criminal defendant is entitled to a defense attorney, the system is far more "fair" than some places, especially with the "innocent til proven guilty" perspective of the Courts.

Justice and Judgement have different meaning.. A judgement will be done by judge based on the arguments placed before him by the attorneys. Judgement will be the out come of combined effects of arguments of attorneys and judges own prejudices and experience so far. The judgement may go against the Truth , as the evidence is powerful than the truth in the eyes of Law..
in this process the Justice may die but Judgement , Law, Legal system lives
If Justice was generally fair , why Socrates was poisoned.. why Jesus was crucified..Why Galileo had to apologize for his discovery that Sun does not rotate round the Earth but Earth does.

Two words. I wish.
If you really want to condense that short answer further. The answer is no. Justice is generally, at least in my understanding and experience of it, not fair.
It may attempt equity, and succeed to some degree of that state, justice is neither too devastating in denial and punishment, nor sweetly gratifying when doling out the spoils.
The question therefore that begs to be asked is-
"was that fair enough for you?"
When neither parties are happy with the outcome, and neither parties are aggrieved anymore "it will have to do.."

It depends that which needs justifying and/or on it's severity.
Like I don't believe in killing for any cause, but I do believe that nobody should get away with any harmful crime.
I don't believe in unjust laws, so I say that until those laws are justified, just act dumb and do what's right. If you get hurt or threatened make a non-violent stand with confident righteousness, and that's pretty much all you can do until heard, although most of this stuff falls on def, dumb, and stupid ears, and is why it would be that way in the first place...(ahem Howard & Bush)

P.S. I also agree with Cabrobst and think that's the case with most of the world.

It depends how justice is done. If justice is done on the basis of fair trial of evidence such justice will be fair,otherwise, not. Generally it depends on the righteousness of the Judge.

Fair from which side? People being judged may find a harsh sentence unfair, but the rest of society may find it fair.
It's all in the perspective. But if you're talking about corruption, or bias then I doubt it. Of course a judge should try as much as possible to not be lenient in a way, but I believe that subconciously a person might be biased because of previous experiences.

I believe it will never be. Justice is not equally applied to all men. The rich becomes richer and the poor becomes poorer. Is there justice there?

I have experienced the courts and in my perception it's only half fair, like in the toss of a coin, half the people in American prisons are not guilty of what the courts say they are guilty of.

Haha i don't know . Justice doesn't have a real explanation to be given. Although if you are my sister you spill anything you see or hear. It is her sole porpouse in life (TO KILL ME)
