the tiem....is it illegal and over looked or what?

A bar is actually a private place of business, not a "public" place like a park or airport. They don't have to let you in if they don't want to, or have to serve you.
Therefore they can set their own standards about what is acceptable behavior.
Whereas, you and your kids could walk into a public restroom or airport bathroom and see Mr. Craig doing it with some guy which would surely violate yours and my standards. (And I would knock his teeth down his throat too!)

1. An actual difference, although not the legal distinction, is that a bathroom has only persons of one's own gender, so any soliciting there would be homosexual; the bar has persons of the other gender, so heterosexual solicitation can occur.
2. In a bathroom, persons solicit to do something in the public bathroom, which is illegal; in a bar, they solicit to go somewhere else, like an apartment or hotel room, not to do it in the bar itself.

II.
If you are asking because of the Senator who recently pled guilty:
a) he probably would not have been arrested if he had not copped an attitude that implied that he felt Senators were above the police.
b) although the original reason for police involvement was alleged intend to engage in lewdness, the charge to which he ultimately pled guilty was disorderly conduct.

First of all, it is illegal to "solicit" (i.e., for money) sex anywhere except Nevada. Parks and bathrooms are public and getting naked in public is against the law, as is having sex in public. It is also illegal to have sex in a bar. The bar owner might not call the cops, but they sure will kick you out for good if they catch you getting naked or having sex in there. If you meant meeting someone at the bar and then going home with them, then "home" is not in public. It is completely legal to meet someone in a public place as long as you do the other stuff (sex) in private.

Not a lawyer. My take is that public bathrooms in parks, malls etc., are places where minors are present. Bar rooms, lounges are people of legal age and consenting adults.

I am not a lawyer but it may come down to common standards such as "violating the community standard of acceptable behavior", and the "expectation of privacy" is slightly greater in a bar/ lounge as opposed to a park, airport, etc. Not sure just my thoughts.

Bars and lounges are private entities. Bathrooms in parks are public. Difference. BIG difference. BTW; you can get arrested for being drunk in public too. Even if ur just walking.
