i have been whitnessed that i was smoking a cig on the bac of the work van whyle filling plant machines with deisel but all the staff @work knows i stopped smoking the day the ban came in to place but the bosses dint no i stopped but the point is i had a white pen in my mouth

probably not, unless they have security cameras that could back you up.

besides, sounds like they were jerks - maybe you are better off..

If they just laid you off, then you don't have a case because most employment is employment at will. In other words, they can terminate you for any reason at any time as long as it doesn't have anything to do with race, religion, gender or age. If they fired you for "misconduct" I would contest that and provide a witness that could vouch for you.

Tell them you quit smoking days earlier. If they don't believe you, tell them that unless they can prove your were smoking, and it wasn't a pen, you will sue them.

If you sue them, you'll win. Any decent attorney will tell you that witnesses are the worst proof in court, and any good attorney can tear apart a witness testimony especially if they can't be positive as to what they saw.
