He's taking work off to take care of his wife who's having surgery. Doesn't he still have to send his kids money? It comes right out of his check usually.

guess it won't come out of his check if he doesn't get a check that 2 weeks, now will it?
OMG....look at all the damn women here say "HE DOES"....just like a bunch of money hungry women.....doesn't give a crap how much money he has for his needs, or care about his wifes health, huh?

He has no option. The papers just say he has to pay "x" amount of money so many times a month. To get that changed for any reason he'd have to file paperwork in the court (think it's called a modification request, but not certain). I know in TX the money paid goes directly to a government agency and after three missed payments the deadbeat gets picked up and put in jail. Your kids still have expenses that need to be paid while his wife is having surgery.

Yep, he'll be backed up on support. Child support recovery unit will eventually come after him for it if you are in a state the requires their services. Otherwise you can contact them and pay $25 and they'll go after him as well.
The only way he would not be obligated is if he makes a request from the courts. Even then you are still accruing the back support.

Sounds like he is going through a really hard time. He probably isn't doing this to be ugly or neglect the children. Why can't you cut him some slack this time? I am a woman, divorced however I feel obligated to help where I can. I think of my ex like a brother, though all we talk about are our children. Is it possible to find a heart and let him slide once? If you are too broke work something out with him. No point fighting about it.

Check your jurisdiction but my understanding is the only thing that can change the support payments is if he is self-employed and his income decreases. The courts DEMAND that he take care of his kids!

Since he must pay you through payroll withdrawals, I assume that he hadn't been paying at all, prior to this. I think he just doesn't want to pay you.

Regardless of the reason he will be off work, his children still come first. They still need food, shelter, transportation, and all the other things that having a child entails. He does indeed still have to pay support!

Yes, he still has to pay. Even if he loses his job and has no income, he is still held accountable for paying child support. My ex tried to pull that, so I took him to court. He is paying back child support. Don't let him get out of his obligation.

Child support comes BEFORE his wife. If he doesn't pay willingly they will make him repay it out of the next check he gets on top of normal payments.

you need to ask the child support office about that. I know in some states yes but in others he would only have to send half of it

Yes, he still has to pay. If he doesn't, when he goes back to work, double the amount will be taken from his first paycheck.
