in the high school that i go to they take your cell phone for 5 months if its your second offense. I mean you still have to pay for your phone bill while they keep it for 5 months, this is all on the second time you get caught is the legal or illegal

the school wont give it back even to the parents after the student has got its phone taken away before, this is the punishment for the second offense, i mean what if you parents own the phone

As long as they warn you it should be legal. You should have not been using your Phone when the school says you are not allowed to. Your parents may be able to get it back, but you broke the rules.

Unless you can demonstrate some sort of necessity to have your phone on and with you at all times I don't think you can do a thing. I would suggest getting a new cheap phone and having your old one deactivated. I don't mean a new contract/service. I mean going to the phone place and telling them you want your phone service put on a new phone because you lost your old one. I think a new cheap phone will be about 40 dollars?

If you and/or your parents signed a statement agreeing to the school rules, then anything they do is fair. If you were so inclined, I suppose you **could** take the school to court to call them out on the legal issues, but don't expect to get very far.

If you don't like the idea of the school taking your phone away for 5 months, then don't break the rules. Plain and simple.

Yes.

Our cell phone policy is parent has to pick it up for the first offense and our second offense we get suspended until a parent-administrator conference

Your parents can go pick up the phone, then they can be the ones to keep it from you for however long it takes for you to learn to follow the rules.

If someone would take this to Court, these two-bit tyrants would find out that there are a lot of things they do that they can be forced to eat. Especially if the parents own the phone.

I would think that is illegal. Your folks should speak to the school.
