I recenlty got married and am in the process of changing my name. I bought a house with my fiance prior to getting married. The deed is in my maiden name and his name. The mortgage is in only my name and I just changed it to my new married name. That leaves the deed. Do I need to change the deed to reflect my married name since the mortgage is now in my married name?

The deed has two persons on it, but the mortgage only one? Probably not, but whatever they agreed to.

You don't "change the deed", you either a) both sign a quitclaim deed to the new name, or b) (the better way) simply file a "name change affidavit".

The affidavit should state:

1. you're of legal age to make an affidavit
2. you understand the consequences of an oath
3. your name was X, and is now Y, by virtue of marriage to Z on (date).

Signed, witnessed, and notarized suitable for recording on the land records, and file it with the land records clerk.

No reason to change your name on the deed, which would generally be accomplished via a "correction deed," but I guess if you wanted to spend the money you could do so.

When you go to sell the house, you'll likely sign a "Same Person" or "Same Name" affidavit which shows all the names you've been know by, including maiden or nicknames so there won't be any issues with the title company.

As long as you are paying the mortgage on time it should not affect you. The bank doesn't care as long as they get their money. If you are having issues paying it then foreclose otherwise, I don't think it is a smart decision to give the property to the bank as you will loose and still have to pay on the property. My best suggestion is to locate employment. Perhaps I misunderstood your question but if your husband is living in this residence and working, he should assist with paying the mortgage while you are looking for employment which would prevent the home from foreclosing. Something you also want to do is keep in touch with your lender and let them know what is going on. I wouldn't think about buying a new home until you get out from under this one.

I believe it will show up on the records for the property that you got married but the actual deed will have the original name. Call the Clerk of Courts office that records all office documents for your county/city. They would be able to help you. If they can't call a title company.
