i am a indian lady i have two elder sons my husband left me four years ago i dont know where is he.my father-in-law know but he did not tell me.one month ago he came back india and we living together after one month he go back africa.meanwhile i knew he has fraud signature of mine in divorce papers and remarry at kenyan girl three years ago andhe have a baby girl also.now what can i do?which indian law to justify me.?please help me.

First collect all those certified documents regarding your divorce from the court were you say he used your forged signatures & took unilateral divorce using these. You can file criminal complaint against him for using forged documents in the legal process under section 465,466,468,471,474, of the Indian Penal Code. If you can collect details about the form & ceremonies of his second marriage & such details can be used as an irrefutable piece of evidence to prove his second marriage beyond any doubts then you can also proceed against him for criminal complaint under section 494 of the Indian Penal Code for the offence of bigamy. You can even proceed against him for the offence of cruelty under section 498A of the Indian Penal Code for committing cruelty against you by his act of remarriage during your marriage subsisting & the divorce granted against it was not legal but void as it was taken your forged signatures for the purpose of cheating. All these provisions I have mentioned here require strict proof on the basis of evidence that cannot be refuted or disproved in the court for you to get him behind the bars otherwise he will keep on enjoying his life with a new wife & you will be left unattended with your children.

I am very sorry about the pain you are going through.

You need to gather, as much as evidence possible, about your husband's fraudulant signature papers, filing dates, court documents, his current wife's name, child's name, address in Nairobi, his date of borth, his last arrival and departure from India. Then hire a good family law attorney and prosecute this man to the fullest extend of the law. Make sure you include your in-laws in the suit cuz they know everything and helping someone commit and co-operate in fraud is also illegal.

You do not want to play emotional game here. You should make an example out of him.

is he still a indian citizen,and do u have any proof of his marriege ,like photograph or any document,if yes find his adress in the country he is staying,most important thing why did u let him stay with u after he had come back ,and y u did not take his adress,the police is also going to cross question u.he would be saying that it was all with ur consern.so first of all u need a proof that he has forged u signature,then u can go to court against him and ur inlaws.

It is very unfortunate that your husband's antecedents were not checked before you got married to him. Lot of cases do happen like this. I am not very sure whether there is any Indian law which can help you. But there are women organizations which help out people who have problem like this. Approach them immediately and first you should catch your father-in-law and through you have to get your job done. Don't spare your husband. He should answer for the injustice done to you.

So sorry for your pain.. Be glad you're rid of the SOB! You deserve better, now go and find it! Like we say in America : "Lose the Zero and go find Another HERO!" Of course, you'll want to press charges against him for forging your signature. Send his butt to jail, file civil charges too, to collect some money. Get an attorney to advise you with India laws. File A Hibuscorpus which would force him to return back then file a Bigamy - contact the media at Nairobi/Kenya publish his photo and get his 2nd wife to contact you!!

think about the situation objectively. if the same situation has happened to your sister or your best friend what would you advice her. You do it without a second thought. because there are numerous ways of getting into a relationship but there is no single way to get out of a relationship unhurt. god is with you.

One thing my dear "once you go black you never go back".Kenyan ladies are hard to compete with,trust me you have lost your husband and you'll never get him back. Plus Kenyan ladies are heavy in the backside, if you know what i mean. Sorry

it seems he is only screwing u whenever he is coming back to india.u wait for the next opportunity till his next visit to india.once he comes u try to get his passport from him right from the airport.then,lodge a complaint to the police for arresting him for forged signature & frauds.try to put him behind bars.as u stand no chance with him u fight for your and your children's rightful claims for alimony by constantly harassing him.put a lawyar.
