i have 3 tattoos from the same shop . i recently got the 2nd and 3rd in the space of a few days. they are all the same colour ink (black) . but the 3rd tattoo has become badly infected ( my doctors words) .he has gave me steroid cream.
my wrist,where the tattoo is, has a patch of big,firm blisters that has no liquid in and look like a big burn mark .
can i claim damages against them?

its my wifes tattoo.
she got it from a proper tattooist.
she signed nothing.
and kept it clean the same way she kept her others clean.

please no whiners telling us not to get tattoos.
each tattoo has a story behind it or meaning and when i look at someone without a tattoo i think they must have lead a very boring life.
a person without a tattoo is like a page without a word.!

Well, you can always find a lawyer who will gladly file a suit for you and take your money. As to how sucessful your suit will be, that's a different matter. Unless you can prove the tattoo shop didn't use proper sanitation and infection control procedures, you face an uphill battle. Tattoos are always iffy things, and infection always a possible outcome, as are allergic reactions. That's part of the consent form you had to sign to get it done. When you signed that, you pretty much tied your hands, because you were informed and agreed to do it anyway. That means you accepted all those possiblities. Unless there are a good number of complaints that all lead back to this shop, there's not much hope for your suit. And as of yet, you don't have any damages. You won't know what that tattoo is going to look like in the end, only that it's not looking good right now. I would suggest you wait until it's all healed before you make decisions about anything. I've seen tattoos that looked iffy turn out okay, and some that didn't look too bad take turns for the worst. Your's may turn out okay- you never know. But if I were placing bets, I wouldn't bet on your chances for winning a suit.

It is your own fault, YOU didn't research the shop or the artist and you can't prove that they were the cause of the infection. You could have picked up some bacteria anywhere. Also, it doesn't sound as if it is infected, simply going to deep won't cause the skin to fall off, a severe allergic reaction to the ink can. Infections take time to grow, so it's unlikely that an infection would show within hours of getting it done. Allergic reactions however, can go from nothing to severe in a very short amount of time. Go to a Dr and get it checked out, that's all you can do.

As a lover of tattoos and piercings, I have 3 tattoos of my own, and I really doubt that you could sue at all. Firstly you'd need evidence that the artist who done the tattoo stuffed it up (tattoo peeled off), and secondly all aftercare is upto the person who got the work done. All aftercare should of been provided at the time you got the work done.
Also, getting a few tattoos in a short space of time doesn't give your body alot of time to heal imbetween. Maybe consider getting them done a few weeks apart.
As I stated above I have 3 tattoos and am well over 21, and never had to sign a consent form as you have to be 18+ in Aus anyway.

I believe the only way you'd be able to sue the tattoo parlour is if you were able to prove that they were/are at fault.
If you can prove that they're not hygienic in their approach, or the tools they use are/were not sterile, you might have a leg to stand on. Then you'd have to get some organisation such as Trading Standards involved, as well as a doctor who'd be willing to argue that the infection came about as a result of their neglect and not your own.
To be frank, I wouldn't rate your chances very highly of getting a successful case against them.

I dont believe so cause before you get the tattoo you have to sign a waiver. Now unless you could get a really good lawyer but thats alot of $.

I imagine it'd be very difficult to prove there was negligence on their part, and not due to improper care on your part. The fact that it's only one of the three suggests it is simply bad luck.
Infection is an inherent risk of tattoo work, and while the risk can be drastically minimised, it can't be fully eliminated. Just do your best to treat the infection.

It's worth a try, but they will probably say that they did their job fine and it was you who did not care for it properly. Try and get a doctors note saying they were at fault if you can. Good luck!

u cant really sue cause they give u guidlines and rules on how to look after your new tattoo so u obviously have nt been doing that for it to become infected so all in all its your fault not his mate sorry!!!!!
