It is a sexual assault. I am a law enforcement officer in MN and our state statutes consist of 5 degrees of criminal sexual assault. There are 5 categories and they are differentiated by factors such as age of the actor / victim, what type of contact there was, etc. They are all felonies however. You would need to check your state statutes to see where your situation fits. Better yet, go to the police and make a report. Even if you don't know the suspect or it happened a while ago, MAKE THE REPORT. If this person did this to you, they will do it to other females as well and they may not have a car alarm button in their hand at the time.

I believe this constitutes rape, even though he did not penetrate you with his body. Because he used an object to penetrate you, then yes, it would be considered as rape. I agree with the person who said not to take a shower. There is DNA evidence on you and you need to get to the police or hospital ASAP and report this. Time is of the essence. You are a victim. The police and the hospital can put you in touch with people who can help you, but you owe it yourself to stop this from happening again to you or anyone else, and to be vindicated for this horrible crime committed against you. Justice cries out for you to allow the police to find this guy and punish him for what he has done. I am so sorry you are going through this. You did nothing wrong. Remember that.

Bessie,
I am a registered nurse and to be honest with you I don't really believe that this happened to you. I can see you coming on YA for advise possibly after such an incident, however, in this day and time I find it difficult to believe that someone who was just recently sexually assaulted would choose a web site Q &A for advise on how to handle their possible "rape". If you truly were raped quit fooling around on YA and go to the closest emergency room so they can do a rape kit. You are losing valuable time and evidence by asking questions on YA.

Yes, that is rape. That is still "sexual assult"
First of all, DO NOT TAKE A SHOWER. That destroys any DNA evidence that will be on the outside of you. You go to the police as soon as possible! They take pictures and make a report. You give a description so that you can identify later on.
You then go to the hospital and they take samples from your insides for tests. That is also for the police to put on your file.

If this is serious, you were sexually assaulted. Go to the emergency room and get checked out, then call the cops if you can.
I don't know where you are, but you can google the Rape Crisis Center where you are. They will have a toll-free number for you to call with any questions.

I believe that contitutes sexual assault, but not rape as there was no genital to genital contact. Possibly attempted rape but it would still be charged as sexual assault. I'm so sorry you had to go through this. Do you have a description you can give the police of your attacker?

oh yeah its definetly rape and u could definetly get justice, i would encourgae u to find a lawyer or something...
1)u can get him for unlawful entry into a motor vehicle
2)u can get him for assault
3)its still rape becuz he had the intent...if u've ever seen "to catch a predator", they arrest the predators even tho the pretadors never even touched the kid, the reason they can do this is becuz the intent was there
