I'm not advocating or anything, but isn't it hypocritical to arrest someone for paying someone else for sex? I mean if I pay someone to have sex with me (no i've never tried), then I could get arrested. But if I pay someone to have sex with me, film it and sell the film than that is ok?

Where is the line drawn? If I filmed it for porn, but didn't sell any copies would it now be considered prostitution?

The main reason used for the legality of porn is that suppressing it would violate the persons first amendment rights to freedom of Speech. Paying someone for sex is not a protected right. However, each state has the right to create laws as they see fit. So not all states make prostitution illegal. Nevada has many legal brothels.

There are some good arguments for legalizing prostitution, it allows them to be regulated and safety standards to be implemented.

However, it also draws a type of crowd that is not what would normally be considered middle class. People would object to having their children exposed to this environment.

And let us remember, the United States is a government by the people and for the people. So this essentially means majority rules. Currently the people of the U.S. have decided that they do not like prostitution, at least the majority has decided this, so until the mood swings in the other direction this is going to be the defacto law of the U.S.

2 things come to mind.

According to a documentary I watched the Catholic Priests of England consider the convent they're own personal free brothel.


The other is the High profile arrest of a madame did not get charged with prostitution but tax evasion.

I also agree that it should not be a government mandated issue and left to individual areas to govern and approve or deny license to maintain a business in an area.

I personally find porn so ugly and corrupting but have been unable to watch TV and not see porn on now even prime time TV.

In my opinion soap operas including women having sex with men with no intention or thought for the child that may be conceived is porn. This would include all shows that imply sex is for fun and not the man and women in an ultimate communication of life and love. In a protected vow to commit themselves to the possibility they may produce a child.

In porn, people are not being paid to have sex -- they are being paid to look (act) like they have having sex -- if they choose to actually have sex, that's outside the contract.

The real (practical) reason is that no court wants to get into a legal contractual dispute involving sexual services.

If prostitution were legal, like dry-cleaning -- then one party to the transaction could sue the other for breach of contract. No court wants to deal with that -- so, they keep it illegal.

With porn, the contract is for acting -- and that's something a court can deal with just like any other acting contract.

Prostitution is illegal because of religious wackos dictating morality to the rest of us. They want to dictate you dont watch porn, as well. The Victorian era is still residually oppressing sex in general. Granted, in those days that was good practice due to the health implications, but in this day and age I fail to see the significance. Of course, the unintended pregnancies and consequential abortions would really get them in an uproar...

If it were legal anybody could be one. I would think it best to regulate, license, and tax it like in Poland, but you can bet if it were legal plenty of people of both genders would be willing to do it for a living, and plenty of both genders would be willing to be customers.

People are still really uptight and uncomfortable with their sexuality. Especially Idaho Senators.

Actually, I think prostitution *should* be legal. It's called "the world's oldest profession" - so I highly doubt it's going anywhere. Why not legalize it, tax the hell out of it, and regulate it? Doing so would keep both the prostitutes and customers safer, and frankly, I think it's a waste of police time and effort to bust 2 consenting adults.

Porn got listed by bug eyed judges as "Free Speech". When their palms did not become hairy, (LOL) they decided it was OK.
Prostitution is legal in Nevada at least Vegas, but contributes to the spread of sexually transmitted diseases) or STDs when done by amateurs oftimes.
