i live in the state of florida and filed my intent to relocate with my children, which was objected to on the last possible day.my lease was up on my home,i had a job lined and and children were set to start school,so i left the state anyhow. the father has never payed child support, does not have a valid drivers license,or a job,has had to have1 restraining order against him from me already,is 35 and still lives at home with his mother and g/f who is on felony drug probabtion and has lost custody of all 5 of her children.when i went back to florida for the court hearing on the return of the minor children, the judge did not want to hear anything regarding the situation on my move, nor about the delinquency and unresponsible issues the father has.instead he automaticall ordered me to give the father custody till a hearing can be set,or move back, which neither is an option for me.is there anything i can do to get this ruling changed,or get a temp order till the hearing. i was given1 week

The made the current order because you must first obtain a court order before you change the pemanent residence of a child to another state.

Don't despair. File for an emergency ex parte hearing regarding your move. This is your only option. Perhaps you will be in front of another judge who will hear your case. If not, you will have to file a formal motion to request your move. You will likely be allowed to move, however it will take some time.

YOU MUST MOVE BACK. Do NOT give him custody and do NOT disobey the court's order.

You can appeal the order -- but you're facing an uphill battle.

You should have appealed the order before you left -- now, having already violated the court's orders once, you are in a much weaker position asking for anything else.
