The ACLU has nothing to do with this type of case.
Their focus is on constitutional violations by govt authorities, most often violations of the 1st, 4th, 5th and 6th Amendments. If something is not a constitutional violation by the govt, then it's outside the scope of their agenda.
What you're talking about is passing laws that limit civil recovery -- those aren't generally a constitutional issue, so it's not something the ACLU would get involved in.

The ACLU is a political organization masquerading as a organization that defends the constitution.
If your cause is a liberal one, they're there. If it is a conservative one, they're busy elsewhere.
