my friend has been seing a man for while now. he's still married but has been saperated for awhile now. he told her that he already started to file for a divorce. after a while he told her that everything in on hold and they can't file for anything because his wife refuses to sign the summons. now i didn't believe that was possible and i told her that in that case it would be even easier for him to get a divorce since she won't even be in court. but she doesn't beleive me. and think the guy is just playing with her.
so i would like to know if you guys have any info about this.

The divorce would go on as planned. The process server would sign off that he served her the papers whether she signed or not (constitutes legally served) and then she would just be a no show in divorce court on the date assigned and he would automatically be awarded the divorce and everything he asked for. I seriously think this guy is playing your friend and has no actual intent of ever getting a divorce from her. Tell her to get out of a possible bad situation while she still can

There is some truth to it. Sometimes it takes serving the person in very public and embarrassing place or catching them by surprise. The divorce could go through but the refusal to accept the papers can delay the process by over a year. There should be some public records she can access showing the summons were refused or not. This is a matter of public record. She may have to go to courthouse in person to see the records or you can do it for her.

by refusing summons u r disobeying the direction of the court and u r loosing ur rt of contesting the case and it is possible to get an ex party decree against u.
u have an opportunity to join the case and let it be contested if he really filed a case against u.
or u may file an application to set aside the decree if it is already passed
advice ur friend to meet an advocate of her jurisdiction.
if it is a legal notice as i understood, u will about to receive summons from court of law soon, if he files a divorce petition and receive it and meet an advocate.
better solve problems through mediation.

All they need is an address and the papers will be mail.I been through two divorce and all they ever had was the address and everything always went through so what he is talking about i have no idea.
