I joined Bally Total Fitness. on Saturdy 8/18. I went to the gym 3 times did not like. On Friday I canceled 8/24 before midnight. I signed a 3 year contract. But on the contract it stated I can cancel this agreement at any time prior to midnight of the 5th business day after the date of this agreement, excluding Sundays and Holidays. I spoke with a rep at Bally he told me since I canceled on the 8/24 I was outside the remorse period. Could any one help me in regards to this. I believe I'm right but want to make sure before I call.

Monday thru Friday is 5 days. The day you sign usually doesn't count in such equations (as phrased), nor does the Sunday by the terms of the contract.

So, you have the legal right to cancel, from the facts given.
