Okay, let's look at variious aspects of intelligence agents:
1) Fighting Ability - Bauer has had his azz handed to him a couple of times. He always comes out in the end, but we can't give him the edge here, just because he's good, but there's somebody better. Bond rarely loses a fight, but it's usually due to some fantastical gadget that he just "happens" to have with him. Not really cheating, but not really realistic either. Bourne is a master of improvisiation and hand-to-hand. I mean, he fought off a highly trained, paid killer with a book, for crying out loud! He's gotta win this round.

2) Ability to blend in and/or work undercover: I don't even know why Bond uses false identities. Everybody knows it's him, sometimes even before he introduces himself. Jack Bauer is Jack Bauer. Maybe that's a testament to how efficient he is that he doesn't even try to use an alias. But it kinda defeats the whole undercover thing. Bourne was so far undercover, HE didn't know who he really was! Gotta give it to Bourne. (p.s. - Bourne seems to be the only guy who is even trying to master more than one language. How are you going to fit in around the world if all you speak is English?)

3) Ability to function outside of the box - As stated before, Bond is useless without the gadgets M gives him or the intel Q provides. He's needed his buddy in the CIA (Felix Leiter) or his girlfriends, or sometimes even the local police to get him out of jams. No way can we give this to him. Jack Bauer never follows his superior's orders (part of what makes him a badazz) but he needs their guidance and intel to at least establish a set of options. He's always got someone on the inside sympathetic to him and willing to be the voice at the other end of his earpiece guiding him through his missions. Workable, but still not supreme. Bourne, on the other hand, not only succeeds without anyone with any real clout on his side, he succeeds despite the fact that EVERYONE WITH ANY REAL CLOUT IS OUT TO GET HIM!

No contest. Bourne. Hands down. Baddest azz fighter, most realistic, and most believable.
