Me and my ex husband have been divorced over 8 years. I have custody of the kids and have since remarried. My ex husband is about $5000 behind in back child support. Every time it is his weekend for the kids, he asks me to send food because he doesnt have any. We can barely afford to buy food for our family and then we have to send food to my ex. My ex can work but he refuses to look for work. He will work a job for like 2 weeks and then he quits after the Child support people find out where he is working. I called the child support office and was told as long as he makes a payment or tries to make a payment every 3 months, then there is nothing they can do about it. He is on probation with the child support office for non payment but it's non supervised, so nothing is done about making him pay. What should I do?

My state also suspends your driver's license for failing to pay court-ordered child support. Additionally, my state allows for criminal charges to be brought against a person for non-support. If the child support caseworkers are overwhelmed or understaffed, you might want to contact your local prosecutor's office. An arrest and a night or two in jail seems to produce some pretty quick support payments around these parts.

I have not heard of the 3 month rule anywhere I have lived. It is not your responsibility to send food for his visitation. Just refuse and let him know if your kids are not fed, you will file for sole custody with no visitation. All depends on how far you want to push it. Most States don't care where the parent gets the money for child support as long as it is paid. My State pulls your drivers license for non payment. Gets your attention. A complaint to your State Attorney General may get the CS bureau off their butts also.
