a friend of mine is going through the same thing...she has a child, not a new born. her husband actually called the police on her, when she was trying to move the kids stuff. the police wouldnt let her take the child, as the home was the "permanent residence" for the child. this is the state of north carolina. call your local clerk of court, or magistrates office and they should be able to tell you just on the phone

You can't take your child away from your husband by law unless you have proof that he has done something illegal against you or the child. What you can do is file for divorce and for full custody of your child. Unfortunately, this takes time.

first of all this is your child as much as it is his and you need to go to the court and get custody or joint custody of the child.
Thats the only way this will work under no circumstances would i leave my child that way he could say you abanded the child which will make you look bad i would call the cops if neccessary if he wouldnt let me take my child.
