I want to convert my position to exempt from non-exempt. I meet ALL the administrative criteria for an exempt employee. I work 8-5 everyday and get the same amount of pay but it's paid hourly (althought it was calculated from an annual salary on my offer letter). Is there a statute that says my employer MUST make me an exempt employee if I meet the job responsibility criteria?

There is no law I know of that would force them to classify you as exempt. However, they also do not have to make you hourly just because you want it that way.

As an hourly employee you would be compensated for working more hours if you had to, as an exempt employee you get no overtime. If you have a set work day its probably best to stay hourly. Most exempt managers I know work much more than a 40 hour work week.

No, there is no law that requires them to change you from hourly to exempt.
