I have a cousin who once was having a party... Well come to find out this guy used to peep on her while she would do whatever. Well one night during this party he was caught, but he was caught peeping from the neighbors garage. She wasn't able to press charges cause he wasn't doing anything illegal towards her, but her neighbor ended up pressing charges on the guy for breaking and entering and some other crap.
Overall though the police pretty much told her that there is nothing you can do about people looking through your windows unless they are on your property. They figured the guy peeping did it many times because a few mornings the neighbor noticed objects in the garage out of place,or the door locked when they always kept it unlocked... Simple crap like that.

I think it depends on how visible they are under normal circumstances. If you have to get a ladder out to see over the fence or do something that is abnormal to be able to see them swimming then you might be running afoul in the area of peeping tom laws.
Also, what are the age of the women? If you sit around staring at underage women swimming then you can pretty much expect a visit from the police. Even if the women you stare at are of age or older, but there are some kids present then expect a visit from the police.
If your neighbors have asked you not to do this and you keep doing it then it can be considered harassment as well. Keep that in mind.

No, as long as you remain on your own property. There's nothing from stopping you from using binoculars either, but I don't recommend it, esp. if your neighbor owns firearms.
