My child will be three years old in december her father has done basiclly nothing through out her life. I had filed for child support when she was 9months old. and by the time we went to court he had quit his job ( mechanic) ever since then he's continued not doing anything. I don't have the time or energy to call out from my job to keep going back and forth to court. Since this has happen he no longers works he onlys sells drugs, and recently bought a nissan 350Z. i don't have time for the headache should i file for sole custody or should i ask the court for him to terminate his rights.

You can petition the court to have someone review your case. An ad-litem attorney can represent your child and her best interest. You'll go through some court proceedings but you can win if he doesn't show up to contest it by default.
Stay on to him for child support!

Most courts will not give you the option of letting him off the hook unless you remarry and current husband wants to adopt the child. File for sole custody -tell the court the man is uninterested in the child and that you dont have the time or energy to invest in him anymore. You can tell the court that you will not accept any child support money from him but that it can be put into a trust account for the child-this tells him you dont care about the money, some men think all women want is money, but anyway he is more likely to pay the support if it is in trust for the child and you dont have access to it. Whoever is the trustee for the account should be able to allow you to use some for certain situtations- child mortally ill, university tuition, certain foreclosure on home/ or eviction from home,). You never know maybe he will come around and actually do something.

Firstly, can you prove that he's selling drugs?

In order to file for sole custody, you will have to prove that he is unfit, and while it would be easier to have him sign his rights as father away something tells me he might not be as cooperative. (It's funny how some people will take no responsibility at all for their children, but demand that they be allowed to claim those children as their own...) It's unfortunate for him because even if you do file for sole custody, he will have to pay back support to you for the time he was out of work if he ever does get a job again.

I totally understand why you would want to file sole custody, but you need to speak to a lawyer first and explain that you don't receive child support and know that the father is not working in an effort to keep from paying. Explain that you know about his new car, so you know he has money and believe that he is involved in illegal activities and want to make sure that your daughter is free from any influence he may have over her.

No he is not signing away any rights, and YES you will still receive child support. Sole Custody means you get complete custody of your daughter with your ex (if granted) will get visitations. You will get to make all decisions when it comes to her education, medical and religion. Joint custody menas your ex would have 50% right to make the decisions with you. He still could get visitations with your daughter, but then usually are based off when you say he can have her if you get sole custody. Unless you have it stated in the degree. Good LUck

Most States don't care if a person has a job or not when it comes to child support. Since you would need to go to court for the custody, make it for both the support and custody. Many States will pull a drivers license for non-support.

Usually the courts won't terminate rights unless there is someone willing to adopt the child.

Keep after him for the support.

File for sole custody. Termination is not generally that simple.

try to get him busted for selling drugs! then he wouldn't be free to spend the money he makes!
Or just make him give up his rights
